2. Service Overview
PixelGenAI provides AI-powered tools for creating and editing images, videos, product visuals, marketing copy, and related creative assets from prompts, uploaded files, settings, and other user input. AI outputs may be unpredictable, inaccurate, incomplete, similar to outputs generated for other users, or unsuitable for your intended use.
3. User Accounts
You may need an account to use certain features. You agree to provide accurate information, keep it updated, protect your login credentials, and accept responsibility for all activity under your account.
4. User Content and Responsibility
You are solely responsible for the prompts, uploaded images, product photos, reference files, generated images, generated videos, marketing copy, and other content that you create, upload, store, download, publish, sell, or otherwise use through the Service. You must review all AI-generated outputs before relying on them or using them publicly or commercially.
PixelGenAI does not verify that user content or AI-generated outputs are legal, accurate, original, non-infringing, safe, suitable for commercial use, compliant with advertising rules, or free from third-party rights. You are responsible for obtaining any rights, permissions, releases, licenses, or legal clearances required for your prompts, uploads, outputs, and use of the Service.
5. Content Ownership and License
As between you and PixelGenAI, you retain any rights you have in the content you upload and in outputs generated for you, subject to applicable law and third-party rights. PixelGenAI does not guarantee that AI-generated content is copyrightable, protectable, unique, or exclusively owned by you.
You grant PixelGenAI a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, and modify your content as needed to operate, secure, troubleshoot, improve, and provide the Service, enforce our policies, comply with law, and respond to support requests.
6. Acceptable Use and Prohibited Content
You must follow our Acceptable Use Policy. You may not use the Service to create, upload, distribute, or assist with illegal, harmful, abusive, deceptive, infringing, or unauthorized content, including content that violates intellectual property, privacy, publicity, or other rights.
7. AI Transparency and Disclosure
You are responsible for complying with any laws, platform rules, or professional obligations that require disclosure, labeling, or watermarking of AI-generated or AI-edited content, including synthetic media, deepfakes, advertising, political content, and public-interest communications.
8. Payment and Tokens
PixelGenAI may offer free or paid tokens, subscriptions, usage credits, or other paid features. Tokens may expire, be limited by feature, or be adjusted where necessary to prevent abuse, correct errors, comply with law, or maintain the Service. Payments and refunds are handled under our Refund Policy.
9. Moderation, Enforcement, and Removal
We may review, block, remove, restrict, or refuse prompts, uploads, outputs, accounts, or transactions when we believe they violate these Terms, our policies, third-party rights, or applicable law. We may suspend or terminate access to the Service with or without notice where needed to protect users, PixelGenAI, third parties, or the integrity of the Service.
10. Third-Party Services
The Service may rely on third-party providers for authentication, payments, cloud storage, analytics, AI processing, email, and other functions. Your use of those features may be subject to third-party terms and policies. PixelGenAI is not responsible for third-party services, outages, policies, or actions.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PixelGenAI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
12. Limitation of Liability
To the maximum extent permitted by law, PixelGenAI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, reputational harm, or claims arising from your prompts, uploads, generated outputs, publication, commercial use, or misuse of the Service. Where liability cannot be excluded, PixelGenAI's aggregate liability will be limited to the amount you paid to PixelGenAI in the three months before the claim or 100 EUR, whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless PixelGenAI and its owners, operators, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from your content, prompts, uploads, generated outputs, use of the Service, violation of these Terms, violation of law, or infringement of third-party rights.
14. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms, updating the date above, or using another reasonable method. Your continued use of the Service after changes take effect means you accept the updated Terms.
